Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §2174 is enacted to read:

 
§2174.__Exemption for crabmeat not in interstate commerce

 
A home-based crabmeat processor is exempt from the provisions
of any hazard analysis critical control point program
administered by the department pursuant to the United States Food
and Drug Administration's seafood hazard analysis critical
control point regulations if all the crabmeat processed by that
person is sold for consumption in this State.__All such crabmeat
must be clearly labeled "Not for sale or consumption outside the
State of Maine."

 
Sec. 2. Reimbursement. The Commissioner of Agriculture, Food and
Rural Resources shall reimburse each home-based crabmeat
processor for all fees paid by that processor to attend training
or education sessions on the United States Food and Drug
Administration's seafood hazard analysis critical control point
regulations.

 
SUMMARY

 
This bill exempts home-based crabmeat processors from any
critical control point identification program administered by the
Department of Agriculture, Food and Rural Resources pursuant to
the United States Food and Drug Administration's seafood hazard
analysis critical control point regulations as long as all the
crabmeat processed by that person is sold for consumption in the
State. The bill requires such crabmeat to be clearly labeled
"Not for sale or consumption outside the State of Maine."

 
The bill also requires the Commissioner of Agriculture, Food
and Rural Resources to reimburse all home-based crabmeat
processors for fees paid to attend training and educational
meetings on the United States Food and Drug Administration's
seafood hazard analysis critical control point regulations.
