Sec. 1. Statute of limitations extended for victims of abuse at the Governor Baxter
School for the Deaf. Resolved: That notwithstanding the Maine Revised
Statutes, Title 14, chapter 205 and chapter 741, a person may
bring an action alleging physical or sexual abuse against the
Governor Baxter School for the Deaf if the person was a student
at the school between 1974 and 1998; and be it further

 
Sec. 2. Filing deadline. Resolved: That a person bringing an action
pursuant to this resolve shall file the action within 3 years of
the effective date of this resolve.

 
SUMMARY

 
Current law limits the time to 6 years in which a person may
commence a civil action alleging physical or sexual abuse. This
resolve allows any person who was a student at the Governor
Baxter School for the Deaf between 1974 and 1998 to bring an
action against the school notwithstanding any provision of the
law limiting the time period for which an action may be commenced
or concerning the Maine Tort Claims Act. A person bringing an
action pursuant to this resolve has 3 years from the effective
date of the resolve to file the action.
