Sec. 1. 22 MRSA §1551, sub-§1-A is enacted to read:

1-A.__Cigarette.__"Cigarette" means any product that:

A.__Contains nicotine;

B.__Is intended to be burned or heated under ordinary conditions of use; and

C.__Consists of or contains:

(1)__Tobacco rolled in cigarette paper or in another paper-like substance not containing tobacco; or

(2)__Any form of tobacco that is part of the product and that, because of its appearance, because of the type used in the filler or because of its packaging or labeling, is likely to be offered to or purchased by consumers as a product meeting the description contained in subparagraph (1).

SUMMARY

This bill amends the retail tobacco sales law to add a definition of cigarette.
