| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 17-A MRSA §1202, sub-§1-B is enacted to read: |
|
| | 1-B.__Notwithstanding subsection 1, for a person convicted of | a Class A, B or C crime under chapter 11 who has 2 or more other | convictions of any Class A, B or C crime under chapter 11 or a | comparable offense in another jurisdiction, the period of | probation must be for the life of the person if the person is not | sentenced to a term of imprisonment of 15 years pursuant to | section 1252, subsection 9.__If the person is sentenced to a term | of imprisonment of 15 years pursuant to section 1252, subsection | 9, the person may be placed on probation for and period up to the | life of the person. |

| | Sec. 2. 17-A MRSA §1252, sub-§9 is enacted to read: |

| | 9.__Notwithstanding subsection 2, for a person convicted of a | Class A, B or C crime under chapter 11 who has 2 or more other | convictions of any Class A, B or C crime under chapter 11 or a | comparable offense in another jurisdiction, the term of | imprisonment must be for 15 years if the person is not placed on | probation for the life of the person pursuant to section 1202, | subsection 1-B.__If the person is placed on probation for the | life of the person pursuant to section 1202, subsection 1-B, the | person may be sentenced to a term of imprisonment of up to 15 | years. |

| | This bill requires that a person convicted of a Class A, B or | C sex offense who has 2 or more other convictions of any Class A, | B or C sex offense or a comparable offense in another | jurisdiction must be placed on probation for life or sentenced to | a term of imprisonment of 15 years. If the person is placed on | probation for life, the person may be sentenced to a term of | imprisonment up to 15 years. If the person is sentenced to a | term of imprisonment of 15 years, the person may be placed on any | period of probation up to life. |
