Sec. 1. 5 MRSA §200-H is enacted to read:

§200-H.__Immunity from liability

A person conducting a body cavity search pursuant to a search warrant directing such a search is immune from criminal or civil liability for the act of conducting a body cavity search if the person qualifies as a type of "medically trained personnel" as defined in the rules adopted by the Attorney General pursuant to section 200-G.

SUMMARY

This bill provides protection from criminal and civil liability for medically trained personnel, such as medical doctors and registered nurses, who conduct body cavity searches pursuant to a body cavity search warrant. This bill is the recommendation of the Attorney General.
