Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §1471-Y is enacted to read:

 
§1471-Y.__Notice to abutters

 
Except in the case of an emergency application, a commercial
applicator may not apply pesticides without providing written
notice hand-delivered to each affected residence at least one
week prior to the application.__The notice must clearly indicate
where the pesticide will be applied, that it will be applied no
sooner than a week from the date of the notice and the name and
telephone number of a person whom the resident may contact for
more information about the application.__If no person is at an
affected residence when notice is hand-delivered, the notice must
be left at the affected residence in a conspicuous place, such as
attached to the front door.__For purposes of this section, an
"emergency application" means an application of pesticides
required to be undertaken immediately in order to protect persons
or property.__For purposes of this section, "affected residence"
means any residence on property abutting the property on which
the application will occur and located within 500 feet of the
common property line.

 
SUMMARY

 
This bill requires commercial applicators of pesticides to
provide a one-week advance notice of applications to residences
on abutting property.
