| | Preamble. The Constitution of Maine, Article IX, Section 23 | requires that real estate held by the State for conservation | purposes may not be reduced or its uses substantially altered | except on the vote of 2/3 of all members elected to each House. |

| | Emergency preamble. Whereas, Acts and resolves of the Legislature do | not become effective until 90 days after adjournment unless | enacted as emergencies; and |

| | Whereas, the exchange of this land is necessary for the Town of | Pownal to expand its municipal facilities; and |
|
| | Whereas, the plans to expand the Town of Pownal's municipal | facilities have been completed; and |
|
| | Whereas, the exchange of this land is the last task to be | accomplished before the expansion of the Town of Pownal's | municipal facilities can begin; and |
|
| | Whereas, immediate enactment of this resolve is necessary to | allow the Town of Pownal to expand its municipal facilities | during the 1999 construction season; and |
|
| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, be it |

| | Sec. 1. Authorize Director of Bureau of Parks and Lands to exchange land between State | and Pownal relating to Bradbury Mountain State Park. Resolved: That the Director | of the Bureau of Parks and Lands is authorized to exchange 1.5 | acres of land owned by the State located in Bradbury Mountain | State Park, further described on Pownal Tax Map Number 5, Lot | 39.01, with the Town of Pownal for 4.5 acres of land owned by the | Town of Pownal, further described in Pownal Tax Map Number 5, | Lots 8 and 13, to be incorporated into Bradbury Mountain State | Park. |

| | Emergency clause. In view of the emergency cited in the preamble, | this resolve takes effect when approved. |

| | This resolve authorizes the Director of the Bureau of Parks | and Lands to exchange 1.5 acres of Bradbury Mountain State Park | with the Town of Pownal for 4.5 acres of land owned by the Town | of Pownal. |
