Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 29-A MRSA §1310 is enacted to read:

 
§1310.__Licensed driver education instructors may conduct

 
certain road tests

 
Any person who is certified under subchapter III as a driver
education instructor may, with the written permission of the
Secretary of State, conduct driver examinations for Class C
license applicants.__When granting written permission, the
Secretary of State may set limits on the number or location of
examinations that may be conducted by that instructor or any
other conditions on the offering or conducting of examinations
that the Secretary of State considers appropriate.__Permission to
conduct examinations under this section may not extend beyond
September 1, 2001. The examination fees established in section
1307 remain in effect under this section and remain payable to
the Secretary of State.

 
The Secretary of State shall report by December 1, 2001 to the
joint standing committee of the Legislature having jurisdiction
over transportation on all activity conducted under this section.__
That report must include, but is not limited to, the number of
requests from driver education instructors and the number of
instructors given permission to conduct the examinations.

 
SUMMARY

 
This bill establishes a 2-year pilot program allowing
certified driver education instructors to conduct road tests for
Class C driver license applicants. The Secretary of State is
directed to report on the success of this program to the Second
Regular Session of the 120th Legislature.
