Emergency preamble. Whereas, Acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

 
Whereas, this legislation requires that health insurance
policies include coverage for the treatment of infertility; and

 
Whereas, this legislation applies to all insurance policies and
contracts in effect on or after January 1, 2000; and

 
Whereas, it is necessary that health insurance companies have
sufficient time for preparation of this coverage; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

 
Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 24 MRSA §2320-H is enacted to read:

 
§2320-H.__Infertility

 
1.__Definitions.__As used in this section, unless the context
otherwise indicates, the following terms have the following
meanings.

 
A.__"Infertility" means the inability to get pregnant after
one year of unprotected sex or the inability to carry a
pregnancy.

 
B.__"Treatment of infertility" means the following
procedures provided for the purpose of the treatment of
infertility:

 
(1)__In vitro fertilization;

 
(2)__Uterine embryo lavage;

 
(3)__Embryo transfer;

 
(4)__Artificial insemination;

 
(5)__Gamete intrafallopian transfer;

 
(6)__Zygote intrafallopian transfer;

 
(7)__Intracytoplasmic sperm injection;
