| | Emergency preamble. Whereas, Acts of the Legislature do not become | effective until 90 days after adjournment unless enacted as | emergencies; and |

| | Whereas, this legislation requires that health insurance | policies include coverage for the treatment of infertility; and |
|
| | Whereas, this legislation applies to all insurance policies and | contracts in effect on or after January 1, 2000; and |
|
| | Whereas, it is necessary that health insurance companies have | sufficient time for preparation of this coverage; and |
|
| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, |

| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 24 MRSA §2320-H is enacted to read: |
|
| | 1.__Definitions.__As used in this section, unless the context | otherwise indicates, the following terms have the following | meanings. |
|
| A.__"Infertility" means the inability to get pregnant after | one year of unprotected sex or the inability to carry a | pregnancy. |
|
| B.__"Treatment of infertility" means the following | procedures provided for the purpose of the treatment of | infertility: |
|
| (1)__In vitro fertilization; |
|
| (2)__Uterine embryo lavage; |
|
| (4)__Artificial insemination; |
|
| (5)__Gamete intrafallopian transfer; |
|
| (6)__Zygote intrafallopian transfer; |
|
| (7)__Intracytoplasmic sperm injection; |
