| | | Sec. 1. 12 MRSA §6001, sub-§1-B is enacted to read: |

| | | 1-B.__Artificial breathing device.__"Artificial breathing | | device" means a device that allows a person to breathe | | underwater. |

| | | Sec. 2. 12 MRSA §6623, sub-§1, as enacted by PL 1977, c. 661, §5, is | | repealed and the following enacted in its place: |
|
| | | 1.__Hand implement only.__The fishing for or taking of soft | | shell clams by hand with the use of an artificial breathing | | device is prohibited.__The fishing for or taking of soft shell | | clams, except by implements operated solely by hand, is | | prohibited, except as provided in this section. |
|
| | | This bill prohibits the taking of soft shell clams while using | | an artificial breathing device. |
