Sec. 1. 30-A MRSA §4301, sub-§11, as enacted by PL 1989, c. 104, Pt. A, §45 and Pt. C, §10, is amended to read:

11. Moratorium. "Moratorium" means a land use ordinance or other regulation approved by a municipal legislative body which that temporarily defers development by withholding any authorization or approval necessary for development. An ordinance that limits the number of building permits issued or residential dwelling units authorized during a designated time period, adopted pursuant to and consistent with a comprehensive plan enacted in__accordance with this subchapter, may not be considered a moratorium.

SUMMARY

This bill amends the definition of "moratorium" to exempt building permit limitation ordinances adopted pursuant to and consistent with a comprehensive plan.
