Sec. 1. 12 MRSA §7013, sub-§9, as enacted by PL 1983, c. 819, Pt. A, §17, is amended to read:

9. Rules. The development of rules governing the effective management of the inland fisheries and wildlife resources of the State. ; and

Sec. 2. 12 MRSA §7013, sub-§10 is enacted to read:

10. Fish Stocking; new species; unstocked water bodies.__The adoption of rules pursuant to the Maine Administrative Procedure Act prior to:

A. Stocking a water body that has not been stocked for 5 or more years; or

B. Stocking a species of fish into a water body that has not previously been stocked into that water body.

Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter II-A.

SUMMARY

This bill requires that the Bureau of Resource Management within the Department of Inland Fisheries and Wildlife adopt rules pursuant to the Maine Administrative Procedure Act before stocking a water body that has not been stocked for 5 or more years or stocking a species of fish into a water body that has not previously been stocked into that water body.
