Sec. 1. 22 MRSA §303, sub-§23 is enacted to read:

23.__Termination.__"Termination" means the closing of a health care facility and includes the relocation of a facility to another municipality.

Sec. 2. 22 MRSA §304-A, sub-§5-A is enacted to read:

5-A.__Termination of a health service.__Any termination of a health service by or on behalf of a health care facility, including a hospital, that was previously offered by or on behalf of the health care facility;

SUMMARY

This bill makes the termination of a health service by a health care facility, including a hospital, subject to the certificate of need law. The bill also clarifies that the termination of a health service includes the relocation of a health care facility to another municipality.
